Portfolio II.A: A Civil Action


Read Section II, Chapter 9, pp. 468ff. AND Watch the movie: "A Civil Action." Then, respond to the movies and readings in essay form. Some things to consider: Consider and evaluate the ethics and ethical dilemmas of:

1. Jan Schlichtman:

a. What are his ethics in the beginning? At the end? How and why does he change? Which Jan Schlichtman do you like better and why?

b. What are some of the ethical/unethical things he does to fight this case? Are they worth it?

c. Consider his statement, "I'd do it again," in light of his sacrifice and his situation at the end of the movie; then consider the same in light of his situation years later (re-established as an environmental lawyer).

d. Would you do what he did? Would you be willing to make the same sacrifices? Why or why not?

2. Mr Love, Mr. Grammery, and the other witnesses who worked at the plant:

a. What are their dilemmas?

b. Do you think they should tell the truth ("whistleblow") or protect their position in the company? Why or why not? What are some of the consequences of both of those decisions?

c. What would you do in their position?

3. The lawyers for the defense: (Robert Duvall) and Mr. Cheseman (sp?)

a. Evaluate what they did that was ethical or unethical.

b. In what ways are they admirable? In what ways not?

4. The legal system itself

a. Is it an ethical or just system? Consider some of the issues discussed: defendants must have deep pockets, settlements, the judge arbitrarily bringing in 3 unfair questions to decide if the case moves forward, the judge's motivations for doing so.

b. Consider and discuss Jan Schlichtman's statements: "I calculate success and failure in dollars and cents divided neatly into human suffering." and "A 40 year old white male professional at his highest earning potential is the most valuable client (victim)." What values of our society/legal system are being conveyed?
